Voluntary manslaughter is the charge that a defendant will face if they use one of the partial defences available to those charged with murder.
There are three defences, and these occur when there is killing and the defendant is: suffering from diminished responsibility loss of control; or part of a suicide pact. For the purposes of the AQA Law course, we will be focusing on Diminished Responsibility and Loss of Control. These are partial defences as opposed to a full defence, which completely negates all criminal liability. A voluntary manslaughter charge allows the judge discretion to the life sentence and in some rare circumstances allows them to sentence defendants with anything right down to community sentences. |
